***When an Advocacy Organization Turns Individual Circumstances and Government Decisions into an Attack on an Entire Profession.***

The Bail Project recently published the story of Alfredo, a Jacksonville chef who was arrested following a traffic stop. According to its own account, Alfredo was driving without current vehicle registration or insurance because he could not afford them. Police reportedly discovered illegal drugs in his passenger's possession, resulting in a drug possession charge against Alfredo. A judge set bail at $5,000, which he could not afford. The Bail Project eventually secured his release, and the charges were dismissed approximately one month later.

There is an important distinction between understanding someone's financial circumstances and excusing decisions that violate established laws. Vehicle registration, insurance, and licensing requirements apply to everyone. Financial hardship does not automatically exempt anyone from those obligations. However, an arrest is not a conviction, and the dismissal of Alfredo's charges deserves recognition. The presumption of innocence must remain intact regardless of someone's financial position.

What I find particularly troubling is The Bail Project's effort to use this incident as an indictment of Professional Surety Bail. The professional bail agent did not initiate the traffic stop, file criminal charges, or establish the $5,000 bail amount. Those decisions were made elsewhere in the criminal justice system. If the amount was excessive or the judicial process was unfair, the responsibility should be examined where it belongs. Eliminating Professional Surety Bail would not resolve unlawful driving, questionable arrests, or improper judicial decisions.

We should also examine the financial interests behind these advocacy campaigns. The Bail Project is a nonprofit organization, but it operates with substantial funding, paid employees, and compensated leadership. Its financial reports document millions of dollars in annual expenditures. I often wonder how many organizations campaigning against our profession would continue those efforts if the funding disappeared. Professional bail agents are regularly criticized for receiving compensation for their services, yet the people employed to campaign against them also earn their living through this debate.

I have spent more than 35 years working directly with defendants, their families, and the courts. I understand that financial hardship is real and that the criminal justice system does not always get every decision right. But individual circumstances should be evaluated on their actual facts, not reshaped to support an organization's predetermined policy agenda. The public deserves to understand the difference between the actions of an individual, the decisions of government officials, and the responsibilities of Professional Surety Bail.
